The short version
- DisplayHouse is free, and we're a listing platform, not a real estate agent.
- Only list properties you're allowed to advertise, and keep listings accurate.
- Be respectful, and never pay anything before inspecting a property.
- Your rights under Australian Consumer Law always apply.
1.Agreeing to these terms
These terms apply whenever you use DisplayHouse, which is operated by DisplayHouse (“we”, “us”). By browsing, creating an account or posting a listing, you agree to them and to our Privacy Policy. If you don't agree, please don't use DisplayHouse.
2.What DisplayHouse is (and isn’t)
DisplayHouse is an online platform where property owners and agents advertise properties for sale or rent, and where buyers and renters find them and get in touch.
We are not a real estate agent and we are not a party to any sale, lease or negotiation. We don't inspect or value properties, check who owns them, or verify what listings say. Any agreement is solely between the people involved. Before relying on a listing, inspect the property and get independent legal and financial advice.
3.Your account
- You must be 18 or older to create an account.
- Give accurate details and keep them up to date.
- Keep your password secure. You're responsible for activity on your account; tell us promptly if you think it has been misused.
4.Listing rules
When you post a listing, you confirm that:
- you own the property or are authorised to advertise it, for example as the owner's licensed agent;
- the price, description, features and photos are accurate and not misleading, and you'll update or remove the listing when it is sold, leased or withdrawn;
- you have the right to use every photo and piece of text you upload;
- you'll follow all laws that apply to advertising and dealing in property, including Australian Consumer Law, state real estate and fair trading laws (such as underquoting rules), tenancy laws and anti-discrimination laws; and
- you won't list the same property more than once.
Agents must hold any licence their state or territory requires.
5.Things you must not do
- post fake, misleading or bait listings, or run scams of any kind;
- harass, threaten or discriminate against other users;
- send spam or use other users' contact details for anything other than the listing they relate to;
- scrape, copy or harvest listings or user data, or bulk-access the site by automated means;
- interfere with the site's security, or upload malware or harmful content; or
- use DisplayHouse for anything unlawful.
6.Dealing with other users
Use your judgement when dealing with people you meet through DisplayHouse. Never pay a deposit, bond or holding fee before you've inspected a property in person and confirmed who you're dealing with. Be wary of anyone asking for payment in gift cards, cryptocurrency or overseas transfers.
If something seems wrong, report it to us.
7.Your content
You keep ownership of the listings, photos and messages you post. You give us a non-exclusive, worldwide, royalty-free licence to host, store, display, resize and format that content so we can run and promote DisplayHouse, for example by showing your listing in search results. This licence ends when you delete the content, except where it has been shared in messages or we need to keep it to meet a legal obligation.
8.Removing content and accounts
We may edit, hide or remove any listing or message, or suspend or close an account, if we reasonably believe it breaches these terms, is unlawful, or puts other users at risk. Where appropriate, we'll tell you why.
9.Fees and changes to the service
DisplayHouse is currently free to use. We may add, change or remove features at any time. If we ever introduce paid features, we'll tell you before they start, and we'll never charge you without your agreement.
10.Our intellectual property
The DisplayHouse name, logo, design and software belong to us or our licensors. You may use the site for its intended purpose, but you may not copy, modify or redistribute it without our written permission.
11.Third-party services
DisplayHouse uses services from other companies, such as Google for sign-in, maps and address lookup. Your use of those features is also subject to their terms. We aren't responsible for third-party websites linked from listings.
12.Our responsibility to you
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, DisplayHouse is provided “as is”. We don't guarantee the site will always be available or error-free, or that listings are accurate. To the extent the law allows, we aren't liable for any indirect or consequential loss, or for loss arising from dealings between users. Where our liability can be limited, it is limited to supplying the service again.
13.Ending your account
You can stop using DisplayHouse at any time and ask us to delete your account by emailing hello@displayhouse.example. Sections that by their nature should continue, such as those about content licences and liability, survive after your account ends.
14.Governing law
These terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of its courts.
15.Changes to these terms
We may update these terms from time to time. We'll post the new version here with a new “last updated” date, and give you notice of significant changes. Continuing to use DisplayHouse after changes take effect means you accept them.
